Hard to tell just from that photo, but the size and shape of the head as well as the roundness of the eyes make this predictably non-venomous. Will help you control varmints around your house and poses no serious danger. You are blessed. If you have a cat, the snake is in danger, though.
Oh, the snake is definitely not venomous. That's the nice thing about living in upstate New York. The snakes are harmless -- and actually helpful, since they eat mice and such. I think the reason we're seeing more snakes now is that our last cat died.

Whoa. Ours, luckily, are harmless. They're mostly garter snakes, although last year we also had an eastern milk snake.
Hope you are not one of those people who are afraid of harmless snakes. They aren't fun to step on, though. :-)
